Menu Food settlement in poison dog food case

I received this from the class action law firm last week. Sorry it is a bit long.

As you may have heard, a proposed $24,000,000 settlement was presented to the Court in a collective effort by both Menu Foods and attorneys representing thousands of pet owners during a hearing last week with Judge Hillman. We are now waiting for the Judge’s approval of this proposed settlement. Although it is not a done deal at this point, we expect the Judge to approve the joint proposed settlement within the next two weeks. As it appears right now, the settlement will include reimbursement to pet owners for all documented expenses related to the food poisoning that caused documented renal failure and the documented original cost of each deceased pet. Unfortunately, there will be no compensation for pain and suffering or loss of companionship as almost every state does not allow for such a recovery by law. Given the vast amount pet owners affected by this recall, it



If and when the settlement is approved by the Judge, we must wait for specific instructions on how and when to submit the documentation needed to present each claim on your behalf. It will be a detailed and time driven process at the Court’s direction. At the present time, there is no way of knowing the length of time it will take for the claims to be approved for payment and how much the payment will be just yet but we are going to do everything we can to make the process as efficient as possible. We should have a better idea of the processing time and anticipated reimbursement amounts once we receive the claim submission instructions from the Court.


Ron had asked about this recently. At least my vet bills for Winston's last weekend will be paid.

What are they asking for in terms of proof that it was their food that was responsible?
I filled out a bunch of forms, though I fed Nutro products exclusively for years. They did ask for proof from the vet that the dog was in renal failure. I also had vet records with blood work (pre-anethetic for teeth cleaning) proving that he was fine up until the bad food came through. He passed away 4 days before the recall, so I had no idea what had caused it until afterwards. It was like he had been poisoned...but no evidence anywhere...or opportunity.
I think they may end up paying on claims of unscrupulous people who didn't use the foods. All of the foods canned at menu foods became suspect in this case...cross contamination from uncleaned machine runs.
On the other hand, there are probably a lot of people out there who didn't have any documentation at all...so no claim.

I still suspect they will get off easy because it is expenses only. All I know is that my lawyer said I had all the documentation required for a claim. They did get a statement from the emergency vet as well.
I read somewhere that there would be a cap amount on the amount people could claim if they did not have all of their receipts. That sounds to me like they are opening themselves up for fraudulent claims.
The judge still has to rule on the settlement. I don't know about receipts...do you usually keep dog food receipts? I never did...and I threw out a lot of dog food during the months after Winston's death.

I am certain, however, that the food is what caused my healthy 4 1/2 yr old to become ill on a Friday, and pass away on a Monday morning.

They can't replace him, no amount of money would ever be enough for that. I really don't care if I get a penny...my dog is gone. I am not posting this to be argumentive, as a lot of posts can get that way. I just wanted to update you all on what is going on with this. Of course, the vet bills went on my credit cards, which still have a large balance, so I certainly wouldn't turn it down.

I would just like to be done with it so I don't have to keep going over that weekend anymore...it is still very painful for me. Some good came out of it though...I found this forum. :D
